You skip the listing process entirely, there's no buyer financing to wait on, and closings can often happen in two to three weeks.

The trade-off is price. A direct buyer will offer less than what you might get on the open market after repairs and staging — but when you factor in commissions, closing costs, repair expenses, and carrying costs during a 60–90 day listing period, the gap is often smaller than it first appears. For sellers who value certainty and speed over maximizing every dollar, a direct sale is frequently the most practical choice.

For a property that needs $20,000–$30,000 in repairs before it would be competitive on the MLS, the math shifts further in favor of a direct sale. And for a seller who needs to close in 30 days to avoid foreclosure, relocate for a job, or settle an estate, the value of certainty and speed may outweigh the price difference entirely.

The Texas-Specific Details You Need to Know

Texas is a relatively seller-friendly state for FSBO transactions. There is no attorney requirement for residential real estate closings in Texas — a title company can handle the closing without an attorney present. However, you are still required to complete the Texas Seller's Disclosure Notice, which discloses known defects and material facts about the property. Failing to disclose known issues can expose you to legal liability even after the sale closes.

You'll also need a valid purchase contract. Texas REALTORS® forms are technically only available to licensed agents, but the Texas Real Estate Commission (TREC) publishes its own standard contract forms that are available to the public at no cost. Using a TREC-approved form protects both parties and is strongly recommended over drafting your own contract.
